When you receive a Part I Provincial Offence Notice you have three options:
OPTION 1 - PLEA OF GUILTY - PAYMENT OUT OF COURT
You are pleading guilty to the charge and you must pay the TOTAL PAYABLE ast set out on the ticket
OPTION 2 - PLEAD GUILTY WITH AN EXPLANATION - WALK-IN GUILTY PLEA
By choosing this option you are pleading guilty to the charge as it is set out on the ticket and you will be found guilty of the charge as it is on the ticket. The Justice of the Peace will speak to you about the fine and the amount of time to pay the fine. It is important to know what the Justice of the Peace can and cannot do under Option 2:
The Justice of the Peace CAN:
- Reduce the amount of the set fine.
- Give you more time to pay the fine.
The Justice of the Peace CANNOT:
- Reduce the charge; e.g. A speeding charge of 20 kilometres over the limit cannot be reduced to 15 kilometres.
- Remove or reduce the demerit points to be applied.
Demerit points are applied by the Ministry of Transportation upon conviction and the Court cannot change the demerit points to be applied.
Option 2 - Walk-in Guilty Pleas can be done on any Thursday - excluding Statutory Holidays, Christmas and Court Closures. Walk-in Guilty Pleas commence at 9:00 A.M. Sharp *Please call the Court Office prior to attending to ensure Court has not been closed
OPTION 3 - TRIAL OPTION: NOTICE OF INTENTION TO APPEAR
If you wish to request a court date, you must sign the notice of intention to appear on the back of the ticket under Option 3 and submit it to the POA Office. Once you submit a Trial Request by signing the back of your yellow ticket under Option 3 a court date will scheduled for you according to availabilty. A Notice of Trial will be sent to you in the mail at the address on the ticket - if you change your address you MUST notify the Court Office of the address change, failure to do so could result in you not receiving your trial notice. If you do not receive your Notice of Trial within 45 days of filing the request contact the Court Office with your 8 digit ticket number to enquire of the status.
